Would i be able to get a new phone?

I found a blackjack 2 a while ago and now the screen is messed up and i went to an at&t store and they told me sense it is not physically damaged i can get a new one if i call a warranty number but i don't know if the phone is a year old so how would i find out? and should i just call the warranty number and get a new blackjack?
